Between Sessions Terms of Participation
These Terms of Participation apply to the Between Sessions educational membership platform operated by David Online Courses, LLC. Between Sessions is a psychoeducational program and digital membership and is not a service of Candace David Counseling.
Participation in this membership does not create a therapist–client relationship and is not therapy.

PLEASE READ THESE TERMS CAREFULLY.
These Terms of Participation (“Agreement”) are a legally binding agreement between you (“Member,” “you,” or “your”) and David Online Courses, LLC (“Company,” “we,” “us,” or “our”) governing your access to and participation in the Between Sessions platform hosted on Membership.io (the “Platform”).
By creating an account, enrolling in a Membership, or accessing any materials, you acknowledge that you have read, understand, and agree to be bound by this Agreement. If you do not agree, you must not access or use the Platform.
1. Platform Description
Between Sessions includes:
A psychoeducational Recovery Path skill library containing prerecorded educational videos; and
An optional paid Parent Membership providing structured psychoeducational content delivered both live and asynchronously, along with community access.
All materials are educational in nature.
The Platform does not provide therapy, clinical treatment, medical care, supervision, or individualized professional advice.
2. Eligibility
Parent Membership
The paid Parent Membership is available only to individuals 18 years of age or older.
Recovery Path Skill Library
The Recovery Path materials are intended for individuals 13 years of age or older.
Individuals under 18 may access the Recovery Path materials only with the consent of a parent or legal guardian.
By creating an account, you represent and warrant that you meet the age requirements above.
If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Children under 13 may not create accounts on the Platform.
The Company reserves the right to revoke access if eligibility requirements are violated.
3. No Therapy; No Therapist–Client Relationship
Participation in the Platform:
Does not establish a therapist–client relationship.
Does not constitute therapy, clinical supervision, diagnosis, or treatment.
Does not replace individualized care from a licensed provider.
All clinical decisions remain between you and your personal treatment team.
If you are experiencing a mental health crisis, you are responsible for seeking appropriate emergency or professional support.
4. Private Practice Courtesy Access
At the Company’s discretion, private practice therapy clients may be granted complimentary access to the Recovery Path skill library while actively engaged in weekly therapy services.
Such access:
Is a courtesy benefit
Does not create additional contractual rights
May be modified or revoked at any time
5. Account Security
You are responsible for:
Maintaining the confidentiality of your login credentials
All activity occurring under your account
You may not share your login credentials with others.
The Company reserves the right to suspend or terminate accounts suspected of unauthorized sharing.
6. Membership Plans & Payment Terms
(a) Billing Options
The Parent Membership is offered as either:
A Monthly Subscription
An Annual Subscription
You select your billing preference at checkout and authorize automatic recurring charges.
(b) Monthly Plan
Billed monthly on the same calendar date as enrollment
Renews automatically unless canceled
(c) Annual Plan
Billed once per year
Renews automatically annually unless canceled prior to renewal
Annual plans are non-refundable
(d) Failed Payments
If payment fails:
Access may be suspended immediately
We may retry the payment method on file
Continued non-payment may result in termination
You agree to reimburse any fees incurred due to failed payments or disputes.
7. 30-Day Refund Policy (Monthly Plan Only)
If you enroll in the Monthly Plan, you may request a refund of your first monthly payment within 30 days of your original enrollment date.
To request a refund, you must:

Submit your request within 30 days
Include the name and email used to enroll
Provide a brief explanation for your request
The 30-day refund:
Applies only to first-time monthly enrollments
Is limited to one refund per individual or household
Does not apply to annual plans
If approved:
Access will be terminated immediately
You will be removed from all Membership areas
After 30 days, all payments are non-refundable, including renewals and partial months.
8. Cancellation Policy
You may cancel at any time through your Membership.io account.
Cancellation:
Stops future billing
Does not refund past payments
Does not provide prorated refunds
You retain access through the end of your current paid billing period unless terminated for policy violation.
If you cancel and later rejoin, you will enroll at the current Membership rate.
9. Founding Member Pricing
If you enroll at a Founding Member rate:
Your discounted rate is locked in for two (2) years, provided you maintain continuous enrollment.
If you cancel and later rejoin, you will enroll at the current public rate.
After two years of continuous enrollment, your rate will adjust to the current Membership rate.
10. Chargebacks & Payment Disputes
You agree not to initiate a chargeback without first contacting us to attempt resolution.
If a chargeback or payment dispute occurs:
Your access will be terminated immediately
We reserve the right to dispute the chargeback
We reserve the right to submit unpaid balances to collections
You agree to reimburse any fees incurred due to the dispute
11. Member Conduct
You agree not to:
Share login credentials
Copy, record, screen-record, download for redistribution, or distribute Platform materials
Record live sessions
Provide therapy or clinical advice to other members
Post defamatory, abusive, unlawful, or harmful content
Use the Platform for unauthorized commercial purposes
Violation may result in immediate termination without refund.
12. Intellectual Property
All content provided on the Platform—including videos, worksheets, frameworks, guides, recordings, and materials—is the exclusive intellectual property of David Online Courses, LLC.
You are granted a limited, personal, non-transferable, revocable license for educational use only.
Unauthorized reproduction, redistribution, recording, or commercial use is strictly prohibited and may result in termination and legal action.
13. Disclaimer of Warranties
The Platform and all content are provided “as is” and “as available” without warranties of any kind.
We make no guarantees regarding outcomes, results, or personal progress.
14. Limitation of Liability
To the fullest extent permitted by law:
David Online Courses, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
If you are dissatisfied with the Platform, your sole and exclusive remedy is to discontinue participation.
15. Termination
We may suspend or terminate access at our discretion for:
Violation of these Terms
Non-payment
Disruptive conduct
Misuse of materials
Termination does not entitle you to a refund beyond the 30-day policy if applicable.
16. Dispute Resolution & Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Platform shall be resolved exclusively through final and binding arbitration conducted in the State of Texas.
By agreeing to these Terms, you:
Waive the right to file a lawsuit in court (except for small claims matters eligible under Texas law);
Waive the right to a jury trial;
Waive the right to participate in any class or collective action.
Arbitration shall be administered in accordance with the rules of the American Arbitration Association (AAA) then in effect, unless the parties agree otherwise.
Each party shall bear its own legal fees and costs unless otherwise required by applicable law or determined by the arbitrator.
If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect.
17. Governing Law
This Agreement shall be governed by the laws of the State of Texas.
18. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
